www.northstarportions.com is the website of Northstar Portion System, Inc., 578 Washington Boulevard, Suite 409, Marina del Rey, California 90292. These Conditions will apply between you and Northstar Portion System Inc., when you buy an item from www.northstarportions.com.

Your contract for purchases made through northstarportions.com is with Northstar Portion System, Inc.
You represent and agree that all goods ordered by you are for your own private and domestic use only and are not for resale.
You must be eighteen years old or older to use this site. If you are under eighteen, you may only use this site with the agreement of, and under the supervision of, a parent or guardian. If you do not qualify, please do not use this site.
You warrant that all details you provide to northstarportions.com for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.
You agree that email can be used as a means of communication, notification and billing between us. Please be advised that we will never ask for personal details or information via email. If you receive an email asking for your personal information, username or password, or payment information, please do not respond and contact our Customer Service team immediately.
During the registration process, you MAY choose a username and password. You are responsible for all actions taken under that username and password and must only purchase from northstarportions.com under your own username and password. You warrant that you will not use a false name or a known invalid credit card to order. Anyone caught deliberately entering an incorrect or fictitious order, or using a known invalid credit card will be prosecuted to the fullest extent of the law. Northstar Portion System, Inc. tracks the electronic 'fingerprints' of every order placed on northstarportions.com to enable us, and all legitimate crime prevention and prosecution authorities, to trace individual users engaging in criminal activities on our website.
Northstar Portion System, Inc. reserves the right to end our agreement with you and to suspend or terminate your access to the site immediately and without notice to you if:

you fail to make payment to us when due; or
you breach any of these Conditions; or
when requested by us to do so, you fail to provide within a reasonable time, enough information to enable us to check the accuracy and validity of any information supplied by you, or your identity; or we suspect you have engaged, or are about to engage, or are connected to or otherwise have way of being involved in fraudulent or illegal activity on northstarportions.com

Your responsibilities if you break these Conditions

You agree that if you break these Conditions, or any liabilities are incurred arising out of your use of this website, you will be responsible for the costs and expenses that we or our officers, directors, employees, agents and suppliers incur as a result of the breach, including reasonable legal fees (if applicable). You will remain liable if someone else uses your shopping account and/or personal information unless you can prove that such use was fraudulent.

Disclaimers and Limitation of Liability

Product Disclaimer: The Product and all the information and recommendations set forth herein are presented in good faith and believed to be correct as of the date hereof. However, Northstar makes no representations as to the completeness, accuracy or medical benefits of the product. The product and information provided is supplied upon the condition that the persons receiving them will make their own determination as to its suitability for their purpose prior to use. Please see your physician before changing your diet, starting an exercise program or taking any supplements of any kind. If you want to lose weight and are under 18, pregnant, nursing, following a diet recommended by a doctor, have health problems such as diabetes, or want to lose more than 30 pounds, see a doctor before starting this or any weight loss program.

Liability

We do not accept liability (except as set out below) for any errors and/or omissions contained in our website and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice.
If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fill an order for a product that was advertised at an incorrect price. In the event that you order an item and the price published on northstarportions.com is incorrect for any reason, we will email you to inform you that we have not accepted your order, and that your order has been cancelled. You will be advised of the correct price of the subject product. You may re-order it if you wish. If you have already paid for the goods in the circumstances described in this clause, we shall refund the full amount within 30 days of the date of order. Should you choose to re-order at the correct price, a separate transaction will be posted to your credit card.
In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question provided that you notify us of the problem in writing at the address stated in the confirmation email within 10 working days of delivery of the goods plus return the goods to us, unless we inform you that return is not necessary. This provision does not affect your statutory rights.
We have taken great care to provide accurate product images for each product for sale on the site. However, the colors we use, as well as the display and color capabilities of your particular computer monitor, will affect the colors you actually see on the screen. We are not responsible for the limitations of your monitor and cannot guarantee that your monitor’s display of any color, texture or detail of merchandise will be accurate. If you are not satisfied with your purchase for any reason, you may simply return the product following the provisions set out in these Conditions.
The products sold on northstarportions.com are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the site or for any products or services purchased from northstarportions.com
We have taken great care to prevent internet fraud and to ensure that any data collected from you is stored securely and safely. However, we cannot be held liable in the unlikely event of a breach in our secure computer servers.
We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labor disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or other harmful material or represents the full functionality, accuracy, or reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website. If your use of the website or the site’s material results in any costs or expenses, including without limitation, the need for services or replacement of equipment or data, we shall not be liable for those costs or expenses.
This website and its material are provided on as “as is” basis without warranties of any kind. To the fullest extent provided by law, we disclaim warranties, whether express or implied, including those of merchantability, non-infringement of third parties’ rights, and of fitness for particular purpose. We make no warranties about the accuracy, reliability, completeness or timeliness of the site’s material, services, software, test, graphics and links. This does not affect your statutory rights as a consumer, nor does it affect your right to cancel an order or return or exchange a product as provided herein.

Sales Tax Policy
Because Northstar Portion System does business throughout the United States and collects and remits sales tax as required by California law, the Northstar Portion System website also collects and remits sales tax as appropriate. Please note, Northstar Portion System reserves the right not to sell to resellers.

Paying for Your Order
Credit card: You may pay for your orders online with major credit cards through PayPal, to verified users, and through GooglePay, who will perform verification and validation of your payment.

Check orders: A downloadable order form is available if you wish to fill it out and send it with a check in the correct amount addressed to Northstar Portion System, 578 Washington Boulevard, Suite 409, Marina del Rey, CA 90292. Check must clear before shipment of your order.

Order Acceptance/Confirmation
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. The Northstar Portion System web site reserves the right at any time after receipt of your order to accept or decline your order for any reason. We reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason. If we reject your order, we will attempt to notify you using the e-mail address you have given us with the order.

Your credit or debit card will normally not be charged if we reject an order, but we will process a refund if the charge has been made against your card.

Order Limitations/Limited Quantities
Northstar Portion System, Inc. may, at its own discretion, limit or cancel quantities purchased per person, per household or per order. Northstar Portion System reserves the right to limit or prohibit sales to dealers. Northstar Portion System also reserves the right to reject any order you place with us. These restrictions may include orders placed by the same Northstar Portion System customer, the same credit card, and orders that use the same billing and/or shipping address. In the event we make a change to an order, we will attempt to notify you by contacting the e-mail and/or billing address provided at the time the order was made.

Return Policy

Shipping
All orders placed on this site are subject to product availability and will be shipped according to Northstar Portion System, Inc. shipping policies.

In the rare event that your order never arrives, notification of lost items must be received within 30 days from receipt of the shipping confirmation e-mail. Please review the Shipping Info page for additional information on shipping times, rates, and policies.

Third Party Information

We are not responsible for material displayed on third party websites or any other written material. The only prices that apply for Northstar products are those stated on Northstar printed material or the website. We cannot vouch for the reliability of prices stated on shopping directories or through any other third party. This website may contain links to sites owned and operated by third parties. Northstar Portion System, Inc. may, in its sole discretion, terminate your account or your use of the northstarportions.com website at anytime. You are personally liable for any orders that you place or charges that you incur prior to termination.
